- About our Terms and Conditions 1.1. Welcome to the Excellence Magazine website. These are the Terms and Conditions (“Terms”) that govern your access, purchases, and use of www.excellencemagazine.luxury, operated by beyond.luxury Sagl with address in Serafino Balestra 9, Lugano, Switzerland with VAT number CHE-482.945.908. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not access or use the Website.
- Acceptance of terms
2.1. By accessing or using the Website, you affirm that you have the legal capacity to enter into this agreement.
2.2. These Terms and Conditions apply whenever you:
– use the website and its functions;
– purchase a printed magazine subscription, a member card, and when registering for an event.
- Intellectual Property Rights
3.1. Excellence Magazine is a brand which belongs to beyond.luxury Sagl.
3.2. All content and materials on the Website, including but not limited to articles, text, images, graphics, logos, videos, and software, are the property of beyond.luxury Sagl or its content providers and are protected by applicable intellectual property laws.
3.3. You may access and use the Website and its content solely for personal and non-commercial purposes. You are not permitted to reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Website without the express written consent of beyond.luxury Sagl.
- Subscription to Excellence Magazine services
4.1. We offer the following products:
– Printed subscription of Excellence Magazine
– Event participation for our own events and/or partner events
– Excellence Member card (EMC) subscription
The order for purchasing these products featured on our website can be made by using the contact form, by e-mail or by phone.
4.2. The Excellence Magazine printed edition yearly subscription can be made at any time and includes the delivery of 4 issues of Excellence Magazine to the provided address by the subscriber. It is your responsibility to ensure the accuracy of the delivery address. By purchasing the yearly subscription, you agree to pay the applicable subscription fee. The subscription fee is non-refundable, except as expressly stated in our refund and cancellation policy (point 5). beyond.luxury Sagl shall not be liable for any delays or failures in the delivery of the printed magazine caused by events beyond our control.
4.3. The Excellence Member card (hereafter referred to as EMC) will give the holder/Subscriber the opportunity to have access, upon registration, to events organized by beyond.luxury Sagl (Excellence Lounge & Excellence Magazine Launch) at privileged prices. By purchasing the Events Card, you agree to pay the applicable fee for the card. The Member card is non-transferable and can only be used by the registered cardholder. Any unauthorized use may result in the revocation of the card without a refund.
Dates and locations of events can be seen in the relevant section on www.excellencemagazine.luxury and on the related social media channels. To register for an event, simply email your name and EMC number to firstname.lastname@example.org indicating the event you wish to attend.
Payment for the event is due up to 7 days prior to the event. If payment requirements are not met, the registration will expire and your spot will be attributed to another party.
Cancellation is possible up to 7 days prior to the event, and the payment will be reallocated towards a future event. Cancellations made past these terms; will neither be refunded nor reallocated.
The Events Card is valid for the duration of one year at the time of purchase. After the card’s expiration date, it no longer grants any benefits, unless the membership has been renewed and the fee has been paid.
4.4. Event participations are intended as reservations to attend a specific event, which can be bought through beyond.luxury Sagl. The same policy as specified in point 4.3 is applied for payments and cancellations.
- Refund and cancellation policy
5.1. The Magazine Subscription can only be refunded on a pro rata base which accounts for the number of issues already consumed. The cancelation request needs to be made at least 2 months in advance of the next released Vol. of the Magazine, otherwise it will be considered as consumed and the magazine will be shipped as planned.
5.2. The fee of the Excellence Membercard (EMC) cannot be reimbursed.
5.3. Refunds for cancelling on a registered event are treated as specified in point 4.3.
- Payment and Billing
6.1. The indicated prices include Swiss VAT for orders made from Switzerland. For orders coming from outside of Switzerland the indicated prices are not inclusive of VAT. This is to compensate for the higher logistics and administrative costs.
6.2. Prices can be changed at any time, without however affecting orders that have already been placed.
6.3. For orders of the yearly Subscription of the Printed Magazine, the Membercard and the participation of event, you agree to provide accurate and complete billing information and authorize beyond.luxury Sagl to invoice the specified amount to you.
6.4. Payment for the yearly Magazine Subscription, the Membercard and events registration is due at the time of order. All payments are final, and no refunds will be provided, except as expressly stated in our refund and cancellation policy.
- Our cancellation rights
7.1. We may suspend or terminate your Subscription to the magazine and/or the Member card program anytime if we are prevented from providing these services to you, are prevented from accepting payment from you due to the applicable laws or other circumstances beyond our control, or if we cease publishing the Magazine or offering the Member card program. If we terminate your subscription for any of these reasons, we will provide you with a pro rata refund to the extent permitted by applicable law.
7.2. We may also suspend or terminate your subscription to the Magazine and/or Membercard program in case you breach these Terms, or in the event of any verbal and/or written abuse of any kind (incuding abusive, offensive or aggressive language) directed towards our staff, customer care team or any other beyond.luxury Sagl personel or member/guest of our events.
- Limitation of Liability
8.1. beyond.luxury Sagl shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Website or its content.
8.2. beyond.luxury Sagl does not warrant the accuracy, completeness, or reliability of the content on the Website or any linked sites. Your use of the Website is at your own risk.
8.3. The Website may contain links to third-party websites. beyond.luxury Sagl does not endorse or assume any responsibility for the content or practices of these third-party websites.
- Changes and/or variations
9.1. beyond.luxury Sagl reserves the right to modify these Terms at any time without notice. Your continued use of the Website after such modifications shall constitute your acceptance of the revised Terms. You should regularly check this section to see if any changes have been made. Significant changes relevant to the subscriptions will be notified to the current subscribers of that product and/or service.
- Governing Law
10.1. The formation, existence, construction, performance, validity and all aspects relating to these Terms and Conditions are governed by Swiss law.
11.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
